  1. DECISION ON MEASURES IN FAVOUR OF LEAST-DEVELOPED COUNTRIES

  4. Ministers,
  5.  
  6.       Recognizing the plight of the least-developed countries and the need 
  7. to ensure their effective participation in the world trading system, and to 
  8. take further measures to improve their trading opportunities;
  9.       
  10.       Recognizing the specific needs of the least-developed countries in the 
  11. area of market access where continued preferential access remains an 
  12. essential means for improving their trading opportunities;
  13.  
  14.       Reaffirming their commitment to implement fully the provisions 
  15. concerning the least-developed countries contained in paragraphs 2(d), 6 and 
  16. 8 of the Decision of the CONTRACTING PARTIES of 28 November 1979 on 
  17. Differential and More Favourable Treatment, Reciprocity and Fuller 
  18. Participation of Developing Countries;

  20.       Having regard to the commitment of the participants as set out in 
  21. Section B (vii) of Part I of the Punta del Este Declaration;
  22.  
  23. 1.    Decide that, if not already provided for in the instruments negotiated 
  24. in the course of the Uruguay Round, notwithstanding their acceptance of 
  25. these instruments, the least-developed countries, and for so long as they 
  26. remain in that category, while complying with the general rules set out in 
  27. the aforesaid instruments, will only be required to undertake commitments 
  28. and concessions to the extent consistent with their individual development, 
  29. financial and trade needs, or their administrative and institutional 
  30. capabilities.  The least-developed countries shall be given additional time 
  31. of one year from the date of the Special Ministerial Session concluding the 
  32. Uruguay Round of Multilateral Trade Negotiations to submit their schedules 
  33. as required in Article XI of the Agreement Establishing the Multilateral 
  34. Trade Organization.

  37. 2.    Agree that:

  39.       (i)  Expeditious implementation of all special and differential 
  40.            measures taken in favour of least-developed countries including 
  41.            those taken within the context of the Uruguay Round shall be 
  42.            ensured through, inter alia, regular reviews.

  44.       (ii) To the extent possible, MFN concessions on tariff and non-tariff 
  45.            measures agreed in the Uruguay Round on products of export 
  46.            interest to the least-developed countries may be implemented 
  47.            autonomously, in advance and without staging.  Consideration 
  48.            shall be given to further improve GSP and other schemes for 
  49.            products of particular export interest to least-developed 
  50.            countries.

  53.       (iii)The rules set out in the various agreements and instruments and 
  54.            the transitional provisions in the Uruguay Round should be 
  55.            applied in a flexible and supportive manner for the 
  56.            least-developed countries.  To this effect, sympathetic 
  57.            consideration shall be given to specific and motivated concerns 
  58.            raised by the least-developed countries in the appropriate 
  59.            Committees and Councils.

  61.       (iv) In the application of import relief measures and other measures 
  62.            referred to in Article XXXVII:3(c) of GATT 1947 (and the 
  63.            corresponding Article of GATT 1994), special consideration shall 
  64.            be given to the export interests of least-developed countries.

  66.       (v)  Least-developed countries shall be accorded substantially 
  67.            increased technical assistance in the development, strengthening 
  68.            and diversification of their production and export bases 
  69.            including those of services, as well as in trade promotion, to 
  70.            enable them to maximize the benefits from liberalized access to 
  71.            markets.

  73.       Agree to keep under review the specific needs of the least-developed 
  74. countries and to continue to seek the adoption of positive measures which 
  75. facilitate the expansion of trading opportunities in favour of these 
  76. countries.
